Parking Contract

Read these Terms and Conditions Prior to Parking

BY PARKING, YOU AGREE TO THIS PARKING CONTRACT.

Please exit without parking within 10 minutes if you do not agree to all terms. This property is not operated by a governmental entity. This facility provides parking only. It does not provide security to persons or property. You are responsible for your safety. We do not take custody of your vehicle. Park at your own risk. We accept no responsibility for loss, theft or damage to vehicles or contents. By this sign, we offer space for private parking, and you accept this offer by parking on this lot. This parking policy is strictly enforced. No Trespassing or Loitering. Property is for parking Customers Only. Parking compliance is monitored 24 hours per day, 7 days per week. Vehicles out of compliance are subject to towing, booting, and parking invoice charges at the owner’s sole expense. Failure to register, pay in advance for parking, underpayment, overtime, improperly displayed receipts, invalid/expired receipts, and unauthorized or improperly parked vehicles are subject to parking invoice fees as stated below.

To park on this facility, you are required to register, submit identifying information, and make timely payment if required. Failure to identify yourself during registration is the same as submitting false or blank information. If you fail to register, submit accurate information, or make timely payment if required, you agree and consent to the facility owner and its agents obtaining the registered owner record, including name and address for the vehicle you are driving, from the applicable state department of motor vehicles, for one or more permitted purposes, including investigations in anticipation of litigation, in connection with any administrative or arbitral proceeding, for use to provide notice to owners of towed or impounded vehicles, and for any other use permitted by the law of the state that holds the record.

 

NOTICE OF LICENSE PLATE RECOGNITION

By entering this parking area, you consent to our terms and conditions found here secureparkingusa.com/parking-contract, including the use of an automated license plate recognition (ALPR) system by Secure Parking and its business partners for security and parking enforcement purposes. The ALPR system will capture and process your vehicle’s license plate information. The collected data may be used to verify parking authorization and enforce parking rules and regulations. Unauthorized parking may result in fines or towing. This information is collected and used in accordance with applicable laws, including the Driver’s Privacy Protection Act (DPPA).

By parking here, you consent to receive SMS text messages, emails, and other forms of written communication for compliance purposes.

If you receive an invoice and wish to dispute it, please follow the below directions, which will also be included on any invoice.

  • If you believe you received an invoice in error, you must file a dispute with the parking lot owner or operator, Secure Parking USA, LLC, within 15 days after the invoice is placed on your vehicle or postmarked, if sent via mail. The dispute must be mailed or emailed to violations@secureparking.com
  • Within 5 days of receiving the dispute, the parking lot owner, Secure Parking USA, LLC, must render a final decision regarding the disputed invoice.
  •  Final dispute decisions may be appealed to a neutral third-party adjudicator (Effective Arbitration, Inc.) If the appeal is approved, the invoice is dismissed. If the appeal is denied, the party shall pay the original invoice within 15 days of the adjudicator’s decision.

ARBITRATION: Except for appealed invoices, ANY DISPUTE between you or the Owner or Operator arising from or relating to this Contract or lot, including disputes over arbitrability or the scope, validity, and enforceability of this Contract, SHALL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. The arbitration shall be administered by JAMS under its Comprehensive Arbitration Rules & Procedures and the Expedited Procedures. JAMS Mass Arbitration Procedures and Guidelines will apply if 10 or more similar Demands for Arbitration are filed against Secure Parking USA, LLC. JAMS Rules are available at www.jamsadr.com. The Arbitrator shall award fees and costs to the prevailing party as permitted. This Contract is governed by the Federal Arbitration Act. You or the owner can (a) opt out of arbitration by submitting a form to {insert email for opting out of arbitration} within 30 days of entering the lot, or (b) if a suit qualifies for small claims court, either party may compel resolution of a dispute in small claims or an equivalent court on an individual basis only. YOU AND THE OWNER INTENTIONALLY AND VOLUNTARILY WAIVE RIGHTS TO (1) HAVE A JURY TRIAL; AND (2) PARTICIPATE IN A CLASS ACTION, REPRESENTATIVE ACTION OR CLASS ARBITRATION.
